Terms of Service
Article 1 (Application)
These Terms set out the conditions for use of "Euthopia Games" (the "Service"), a game-publishing platform provided by 株式会社Eureka Labo (Eureka Labo, Inc.; the "Company" or "we"). They apply to everyone who uses the Service (each a "User").
Article 2 (Definitions)
"Game" means browser-based content that a User publishes on the Service.
"Creator" means a User who publishes a game on the Service. "Buyer" means a User who purchases a paid game or an in-app item.
"Euthopia account" means the shared Euthopia account provided separately by the Company. The Service does not issue its own accounts; it relies on authentication via the Euthopia account.
Article 3 (Accounts)
Publishing a game, purchasing a paid game, and registering favorites or ratings require signing in with a Euthopia account. Playing a game itself (a free one) does not require signing in.
Account registration, withdrawal, and password management are governed by the terms of the Euthopia account. The User is responsible for managing their account and may not lend or transfer it to any third party.
A minor who makes a paid purchase on the Service must obtain the consent of a person with parental authority in advance.
Article 4 (Publishing a Game)
The Service does not review the content of a game in advance of publication. Creators publish their games on their own responsibility.
As a technical constraint, the files you upload may total no more than 500 files and, once unpacked, an aggregate size of about 30 MB, and must include an index.html. Publication is not accepted unless these conditions are met.
Information such as supported devices and display size is posted based on the Creator's own declaration. The Company does not verify its accuracy.
Paid publication is limited to games delivered from the Company's servers. A game delivered via an external URL cannot be made paid.
Article 5 (Creator's Representations and Warranties)
The Creator represents and warrants that, with respect to the game it publishes and the images, audio, programs, and other materials contained therein, it holds all necessary rights or has obtained proper licenses to use them.
If a dispute such as an infringement of rights arises with a third party, the Creator shall resolve it at its own responsibility and expense and shall compensate the Company for any damage the Company incurs.
Article 6 (Prohibited Conduct)
In using the Service, Users must not engage in any of the following conduct.
(1) Infringing the copyrights, trademark rights, or other rights of third parties;
(2) Engaging in conduct that constitutes gambling, or giving in-game items, scores, or the like monetary exchange value;
(3) In the paid provision of random-type items (so-called "gacha"), selling without disclosing the probabilities of what is offered, or markedly inciting a gambling impulse;
(4) Publishing content that violates laws or public order and morals, or that defames or slanders others;
(5) Distributing malware, unauthorized cryptocurrency mining, or other code that harms a User's device;
(6) Obstructing the operation of the Service, or attempting to purchase or acquire rights by improper means;
(7) Any other conduct that the Company deems inappropriate.
Article 7 (Purchasing a Paid Game)
Purchasing a paid game requires signing in with a Euthopia account. Payment is supported only by credit card via Stripe, and the currency is Japanese yen only.
What a Buyer obtains through a purchase is the right to play the game on the Service. Ownership of the game's program or data is not transferred.
If the Creator has not completed the settings to receive revenue (connecting a bank account to Stripe), that game cannot be purchased.
Even if, after a purchase, the Creator suspends or withdraws the game from publication, the Buyer may continue to play that game (Article 9).
Article 8 (In-App Purchases)
The content and price of items sold within a game (in-app purchases) are set by the Creator. The Company does not review their content.
Items include those that remain valid on an ongoing basis once purchased (non-consumable) and those that are consumed by use (consumable). The balance of consumable items is managed on the Company's servers.
Even if the Creator stops selling an item, items and balances already purchased are not lost.
Article 9 (Withdrawing a Game)
A Creator may withdraw its own game from the Service at any time. A withdrawn game is removed from the listing and detail pages and can no longer be newly purchased.
If there are people who have already purchased the game, they may continue to play it after withdrawal. Purchased games can be launched at any time from "Purchased games" on My Page.
When a game with no buyers is withdrawn, the game's registration information is completely deleted.
Where a game must be completely deleted for reasons such as infringement of rights, the Company will handle it individually, together with refunds to buyers.
Article 10 (Fees and Payment of Revenue)
For sales of paid games and in-app items, the Company receives a fee at a prescribed rate on the sale price. The fee rate applied is the rate in effect at the time the purchase is made, and any later change to the rate does not apply retroactively.
During the preview release period, the fee rate is 20%, and no plan usage fee is charged. We will give advance notice of the end of the preview release period.
Revenue is paid directly into the Creator's account through Stripe Connect and does not pass through the Company's account. The Company receives an amount corresponding to the fee out of the sale proceeds. The payout cycle to Creators follows Stripe's rules.
Creators are responsible for filing and paying their own taxes with respect to their revenue.
Article 11 (Refunds)
Purchased games and in-app items are digital content and become usable at the same moment the purchase procedure is completed. For this reason, we do not, as a rule, accept refunds for the Buyer's own convenience.
However, if you notify our contact desk within one hour of purchase, we will review the matter and handle a refund on an individual basis.
Even for a request made after one hour has passed, we may respond to a refund on an individual basis where the game does not work properly, where the content purchased differs markedly from the actual content, or in any other case the Company deems necessary.
If a refund is made, the right to use that game or in-app item is lost.
Article 12 (Use of Backend Features)
The Company provides Creators with backend features that can be used for purposes such as rankings and storing save data.
A table that a Creator creates with the "public" setting can be read and written by anyone without requiring authentication. Please use this feature with the understanding that information entered by players becomes viewable by third parties.
Where a Creator uses a player-registration feature within a game, the Creator is in the position of handling players' personal information. The Creator is responsible for the handling of player information in its own game.
The Company makes no warranty whatsoever regarding the availability of the backend features, the integrity of data, or retention periods. Please back up important data yourself as a Creator.
Article 13 (Reports and the Company's Response)
If you discover an infringement of rights, inappropriate content, dangerous behavior, or any other problem with a published game, please contact us via the report feature on each game's page or through the contact desk.
The Company reviews the content of a report and, where it deems necessary, suspends publication of that game. A suspended game is removed from the listing and detail pages and can no longer be newly purchased. The Creator cannot lift the suspension on its own; the suspension is lifted by the Company.
Even after publication is suspended, those who have already purchased the game may continue to play it, because the buyers bear no responsibility. However, where the Company deems it necessary—such as where the game's content itself poses a danger that cannot be overlooked—we may stop delivery together with refunds to buyers.
If you object to a suspension, please contact us through the contact desk. The Company determines whether and how to respond, and does not guarantee an individual reply to every report.
Article 14 (Suspension of Use)
Where a User violates these Terms, or where the Company otherwise deems it necessary for the operation of the Service, the Company may suspend that User's use of the Service without prior notice.
In connection with a suspension of use, published games may become unviewable, and where a Creator has unpaid revenue, its payment may be withheld.
Article 15 (Disclaimer)
The Service is provided "as is." The Company does not warrant that the Service will be free from interruption or stoppage, that no errors will occur, or that it will be fit for any particular purpose.
The Company bears no responsibility for the content, quality, safety, or legality of Creators' games. If a dispute arises between Users concerning a game, it shall be resolved between the parties.
The Company does not guarantee that a Creator's game will be viewed by Users through the Service, or that any particular revenue will be obtained.
Where a User incurs damage due to a cause attributable to the Company, the scope of the Company's compensation shall be capped at the amount that User paid to the Company over the past one year.
Article 16 (Changes to These Terms)
The Company may change these Terms where it deems necessary. Where we make a change that has a material effect on Users, such as a change to the fee rate, we will give advance notice on the Service.
Article 17 (Governing Law)
These Terms are governed by the laws of Japan.
